It incorporates the privacy notice we are required to provide to our customers under the federal Gramm-Leach-Bliley Act (GLBA) and Regulation P, and it describes protections related to the Fair Credit Reporting Act (FCRA) and the Homebuyers Privacy Protection Act.

When you are no longer our customer, we continue to share your information as described in this notice.
How? All financial companies need to share customers' personal information to run their everyday business. In the section below, we list the reasons financial companies can share their customers' personal information; the reasons ABS Home Mortgage chooses to share; and whether you can limit this sharing.

Please note: If you are a new customer, we can begin sharing your information 30 days from the date we sent you this notice. When you are no longer our customer, we continue to share your information as described in this notice. However, you can contact us at any time to limit our sharing.

What we do
How does ABS Home Mortgage protect my personal information? To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards and secured files and buildings. We maintain physical, electronic, and procedural safeguards designed to protect your nonpublic personal information, restrict access to employees and service providers who need it to provide products or services to you, and require companies that work on our behalf to protect your information.
How does ABS Home Mortgage collect my personal information? We collect your personal information, for example, when you apply for a loan or provide loan or account information, give us your contact information, provide your employment or income information, seek advice about your loan, or use our website. We also collect your personal information from others, such as credit bureaus, affiliates, appraisers, title and settlement companies, or other companies.
Why can't I limit all sharing? Federal law gives you the right to limit only: (1) sharing for affiliates' everyday business purposes — information about your creditworthiness; (2) affiliates from using your information to market to you; and (3) sharing for nonaffiliates to market to you. State laws and individual companies may give you additional rights to limit sharing. See the "State privacy rights" section below for more.
Definitions
Affiliates — Companies related by common ownership or control. They can be financial and nonfinancial companies. Our affiliates may include companies related to ABS Home Mortgage by common ownership or control, including affiliated real estate, title, insurance, and settlement-service providers.
Nonaffiliates — Companies not related by common ownership or control. They can be financial and nonfinancial companies. ABS Home Mortgage does not share your personal information with nonaffiliates so they can market to you.
Joint marketing — A formal agreement between nonaffiliated financial companies that together market financial products or services to you. Our joint marketing partners may include banks, lenders, wholesale lenders, title and settlement companies, insurance companies, and other financial service providers.
3. Information We Collect
Depending on the products and services you request, we may collect the following categories of nonpublic personal information:
- Identifiers: name, address, email, phone number, Social Security or taxpayer identification number, and date of birth.
- Financial information: income, assets, account balances, payment and transaction history, debts, and employment information.
- Credit information: credit history, credit scores, and information from consumer reports and credit bureaus.
- Property information: information about the property you are financing or refinancing, including appraisal and title information.
- Application information: information you provide on loan applications (including through our online application portal) and in supporting documentation.
- Website and technical information: information collected automatically when you visit our website, such as IP address, device and browser type, pages visited, and information collected through cookies and similar technologies.
4. How We Use Your Information
We use the information we collect to: evaluate and process your loan application; originate, broker, underwrite, fund, and service mortgage loans; verify your identity and prevent fraud; communicate with you about your application, loan, or requests; comply with applicable laws, regulations, and investor or lender requirements; report to credit bureaus and regulators; and offer products and services that may interest you.
5. How and With Whom We Share Your Information
We may share your personal information as permitted or required by law, including:
- To provide our services: with lenders, wholesale lenders, investors, appraisers, title and escrow companies, credit bureaus, verification services, document custodians, and other service providers who help us process, underwrite, close, fund, or service your loan.
- With our affiliates: companies related to us by common ownership or control, for everyday business purposes and, subject to your opt-out rights described below, for marketing.
- For joint marketing: with other financial companies with whom we have joint marketing agreements.
- As required by law: in response to subpoenas, court orders, legal process, or regulatory or law-enforcement requests, and to protect our rights, property, or safety and that of others.
- In business transactions: in connection with a merger, acquisition, financing, or sale of all or part of our business.
We do not sell your personal information, and we do not share your personal information with nonaffiliates so that they can market their products or services to you.
6. Your Privacy Choices and Opt-Out Rights
GLBA / affiliate sharing opt-outs. As described in the FACTS table above, you may limit (a) sharing of information about your creditworthiness with our affiliates for their everyday business purposes, and (b) our affiliates' use of your information to market to you. To exercise these choices, contact us using any of the methods in the "To limit our sharing" section above. Your opt-out will remain in effect until you revoke it.
Do-Not-Call and marketing communications. You may ask us not to contact you for marketing purposes by phone, email, or mail. To opt out of marketing emails, follow the unsubscribe instructions in the message. You may also register with the National Do Not Call Registry at www.donotcall.gov or 1-888-382-1222.
Text messages (TCPA). If you have consented to receive text messages, you may opt out at any time by replying STOP.
7. Trigger Leads and the Homebuyers Privacy Protection Act
When you apply for a mortgage, a credit bureau may be permitted to sell your information as a "trigger lead" — a notice that you have applied for credit — to other lenders who may then solicit you. The federal Homebuyers Privacy Protection Act, effective March 4, 2026, amends the Fair Credit Reporting Act to sharply restrict these solicitations. Under this law, a consumer reporting agency generally may not furnish a trigger lead unless the recipient makes a firm offer of credit and either (1) already has an established relationship with you (for example, it is your current mortgage originator or servicer, or a bank or credit union where you hold an account), or (2) has your documented consent to receive your information.
ABS Home Mortgage does not sell your mortgage application information as trigger leads. To further reduce prescreened credit and insurance offers, you may opt out of firm-offer prescreening for five years online at www.optoutprescreen.com or by calling 1-888-5-OPT-OUT (1-888-567-8688).
8. How We Protect Your Information
Consistent with the GLBA Safeguards Rule, we maintain a written information security program with administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of your nonpublic personal information. These measures include access controls that limit information to personnel and service providers who need it, encryption of sensitive data in transit and at rest where appropriate, secure disposal of records, employee training, and oversight of the service providers with whom we work. While we take reasonable steps to protect your information, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Cookies and Online Tracking
Our website uses cookies and similar technologies to operate the site, remember your preferences, analyze traffic, and support marketing. You can control cookies through your browser settings; disabling some cookies may affect site functionality. We honor applicable browser-based opt-out preference signals where required by law.
10. Data Retention
We retain your personal information for as long as needed to provide our services and for the periods required to comply with applicable legal, regulatory, investor, tax, and recordkeeping obligations, after which we securely dispose of it.
11. State Privacy Rights
Much of the personal information we collect is subject to the GLBA and is therefore exempt from certain state consumer privacy laws. Where state law applies (for example, to certain website data or to residents of states such as California, Colorado, Texas, Virginia, and others with comprehensive privacy laws), you may have rights to access, correct, or delete personal information, or to opt out of certain processing. Residents of states we serve — Illinois, Georgia, Florida, and Texas — and others may contact us using the information below to ask about their rights. California residents may have rights under the California Consumer Privacy Act with respect to information not covered by the GLBA. We will not discriminate against you for exercising any privacy right.
12. Children's Privacy
Our services are intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us so we can delete it.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated notice on this page with a revised "Last updated" date and, where required by law, provide it to you directly. We are required by federal law to send our customers this privacy notice annually for as long as you are a customer.
